Background Information:
The Consumer Contracts Regulations 2013 gives rights to individual consumers in the area of home shopping. They are intended to give consumers confidence in purchasing goods and services where there is no face to face contact with the seller. The regulations do not apply to business to business (trade) contracts.

Our trading name is TD Spares and our Head Office is situated at 42 Cumberland Road Urmston *MANCHESTER M41 9HR - *PLEASE NOTE that parts cannot be picked up from this address as we are a mail order company only and do not have a 'call and collect' facility at present. 2. We sell spare parts for domestic appliances such as washing machines, tumble dryers, electric cookers, microwaves, food mixers, hobs, vacuum cleaners, dishwashers, fridges and freezers. Catering equipment spares such as tea urn taps, energy regulators, heater elements and thermostats. Gardening tool spares for trimmers, lawnmowers, chainsaws and lawn rakes. Electric fire, wall heater and storage heater spare parts.
3. All prices are non vatable and carriage charges will be indicated separately where applicable.
Delivery
If TD Spares accepts your order, please allow us 7 working days to deliver the goods to you, subject to stock availability, always provided that TD Spares cannot guarantee delivery within these timeframes and shall not be liable for failure to deliver within such estimated delivery time period.This shall be no later than thirty (30) days following acceptance of your order, unless you are contacted by TD Spares via email, phone or fax to arrange otherwise.
Notification of Loss or Damage
The company must be informed in writing within three days of delivery of goods in the event of any shortage or damage and within seven days of receipt of invoice if the goods have not been delivered otherwise the goods shall be deemed to have been accepted by the buyer as being in good order and in conformity with the contract.
We deliver from the UK and use the means of transport that provides the best and quickest service for each area. We reserve the right to require the return of Goods that are not accepted by you for any reason. Upon delivery of the Goods you must carefully inspect them. If any of the Goods do not match the description or appear to be damaged or are lost, do not use the Goods and please Contact Us as soon as possible and inform us of the problem. All queries in relation to delivery should be directed to TD Spares via our contact page. We are mail order only at present and our national distribution centre is located in Birmingham, England. We take care of all the admin in Manchester, so therefore do not have a trade counter 'Call And Collect' facility, but we do endeavour to deliver orders as soon as possible!
We send orders via EVRI, Royal Mail or DPD and they normally reach customers within 2-5 working days (UK) if in stock at time of order. Please check for availability if urgent.
NOTE* If you suspect that you have received the wrong parts, please DO NOT ATTEMPT TO FIT OR RETURN UNTIL you have contacted us. There may be some reason for the part looking different.
Examples:
The manufacturer may have introduced recent design changes.
The part may now be universal across the manufacturer's range.
The part may look completely different but still fit and perform the same function.
We can check the part numbers against your model number to confirm compatibility.
This process will avoid unnecessary costs to yourself if you do not need to return them. But please contact us to let us know of the problem first!
Cancellation Rights / Returns
1 . PLEASE READ ABOVE NOTE FIRST. Private Consumers have a cooling off period in which they can withdraw from the contract for any reason. The cooling off period begins as soon as the order has been made. In the case of goods, it ends 14 days after the day of receipt of the goods. Unwanted goods may be accepted for return after this time period but only at the company's discretion. The cost for returning the goods must be met by the consumer. Once we have received the goods we will refund the purchase price (less any original carriage charges) immediately, or in any case within 30 days. Goods returned without the required documentation, or after 30 days of the notice of cancellation will be treated as abandoned to us and will be dealt with accordingly. Special order, bespoke and made to measure items are strictly non returnable.
2 . You must write to us to cancel your order. If there is a problem with the goods supplied then please indicate this on your written correspondence. The consumer must return the goods to us if they cancel the contract. The cost for returning the goods must be met by the consumer.
3 . If a spare part is faulty, wrong or damaged on delivery the Company will provide a replacement provided that they have not been used / fitted. Transit damaged items must be reported within 3 days of receipt of the goods.
4 . The consumer must notify us of any problems upon receipt or at most within fourteen days of receiving the goods. Consumers must return the parts with the original packaging within 14 days to the address in note 1 in the Company Information section above for inspection / testing before a replacement is issued. As a consumer, it is your statutory duty to take reasonable care of the goods if you intend to return them. Please note Consumer Contracts Regulations 2013 which state 'The extent to which you can handle the goods is the same as it would be if you were assessing them in a shop.' The cost for returning the goods must be met by the consumer. We will only refund the cost for returning the goods if we have sent you the wrong goods which do not match the description on the web page or order form. We will not refund the cost of returning goods if the goods simply don't match your model, as manufacturers reserve the right to make design changes from time to time.
Please Note: Electronic or electrical parts which show signs of being installed or used CANNOT be accepted for refund under any circumstances. Please ensure that what you are about to order is what you actually need!
5 . We will refund your money within 30 days of your correspondence stating your wish to cancel your order. The consumer must return the goods to us if they cancel the contract. The cost for returning the goods must be met by the consumer. Administration fees, where applicable, are none refundable.
6 . If you have notified us of a problem with the goods, we will replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question. The company will not be liable for losses that were not foreseeable to both parties when the contract was made, for losses that were not caused by any breach on the part of the supplier or for business losses and/or losses to non consumers. This does not affect your statutory rights as a consumer, nor is it intended to exclude our liability to you for fraudulent misrepresentation or for death or personal injury resulting from our negligence.
7 . Any complaints should be sent for the attention of the Customer Services Team at the address in the Company Information section above.
8. Business Customers - If you are returning goods for any other reason than they are faulty, they must be returned to us within 7 days of delivery. For a refund the items must be received by us unopened and in a saleable condition. There will be a restocking fee of 10% or £10, whichever is greater, and delivery and return delivery charges will not be refunded.
9 . Description Of Goods
We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. We must emphasise it is in everyone's interest to ensure that the correct items are being ordered and are suited to your particular requirements. Although we aim to keep the Website as up to date as possible, the information including product descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. While we will use reasonable endeavours to verify the accuracy of any information we place on the Website, we make no warranties, whether express or implied in relation to its accuracy. Though we constantly strive to provide accurate and current information on this website, information contained in this site may contain technical inaccuracies or typographical errors. All liability of TD Spares howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.
10 . Pricing
All items are none vatable, we are not currently registered for VAT and as such are unable to provide VAT invoices at present, this is an HMRC instruction.
Orders shipped outside of the UK will almost always be charged customs fees (taxes, duties, processing fees, brokerage fees, etc.) when they arrive. Unfortunately, TDSpares has no control over these fees. If you are not familiar with the customs laws and fees in your country, please check with your local customs office for more information.
11 . Secure Payments
We can process payments from most major credit and debit cards via Opayo (formerly SagePay) who are PCI DSS Level 1 compliant, the highest possible level of card data security, we also offer PayPal (link is external) as an alternative payment method. We check your payment card when we process your order. Your account will be charged at the same time. If your order is cancelled before delivery, we will refund the full amount to your payment card. For security reasons, we do not store payment card details, so you will need to re-enter your card details each time you place a new order. Customs
When ordering products from TDSpares for delivery outside of the EU you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from TDSpares, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the products. Your privacy is important to us and we would like our international customers to be aware that cross-border deliveries may be subject to opening and inspection by customs authorities. All items are none vatable, we are not currently registered for VAT and as such are unable to provide VAT invoices at present, this is an HMRC instruction.
12 . Safety Advice
Notes for the purchase and installation of spare parts
a. All our spares conform to the relevant U.K. safety standards.
b. In the interest of consumer safety, parts should only be fitted by suitably qualified person with the appliance disconnected from the mains.
c. In order to conform to statutory legislation, work on gas appliances must, by law, only be carried out by a competent gas engineer, preferably CORGI registered, and must comply with 'Gas Safety (Installation and Use) Regulations 1998'
d. Fitting of parts by unqualified personnel or fitting parts to incorrect machines, could adversely affect the function or safety of the appliance.
e. If you have any doubts or questions regarding the above, please seek advice from your local domestic appliance engineer.
13 . OUR LIABILITY
If we fail to comply with these terms and conditions, we shall only be liable to you for the purchase price of the Products, we will not be responsible for any indirect or consequential losses that were not foreseeable to both you and us when the contract for the sale of products by us to you was formed.
We will not be liable for losses that result from our failure to comply with these terms and conditions that fall into the following categories:
(a) loss of income or revenue;
(b) loss of business;
(c) loss of profits;
(d) loss of anticipated savings;
(e) loss of data; or
(f) waste of management or office time.
14. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS
14.1 We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system's capabilities.
14.2 You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Despatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).
15. LAW AND JURISDICTION
Contracts for the purchase of Products through Our Site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
